Terms and conditions.

These terms explain the rules for using the Prairie Blue Pools website and purchasing products through our online store. Project services may also be governed by a separate written agreement.

Acceptance of these terms

These Terms and Conditions apply to your use of the Prairie Blue Pools website and to orders placed through our online store. By using the website or submitting an order, you agree to these terms, our Privacy Policy, our Shipping and Delivery Policy, and any product-specific terms presented before checkout.

You must have the legal capacity to enter into a binding agreement. If you use the website or place an order for a business or another person, you confirm that you are authorized to act for them.

If a separate written proposal, construction agreement or service agreement applies, that agreement governs the applicable project services. If there is a direct conflict, the more specific written agreement controls to the extent of the conflict.

Website and product information

We work to keep descriptions, illustrations, specifications, compatibility information, availability and pricing accurate. Pool products contain many supplier-controlled components, and information may change without notice.

  • Images and diagrams may be representative and may not show every included component, colour variation or site condition.
  • Dimensions, capacities, performance information and installation guidance should be confirmed using the current manufacturer documents supplied with the product.
  • Website content is general information and is not a site-specific engineering, architectural, electrical, gas, plumbing, geotechnical or legal opinion.
  • Products and configurations remain subject to availability, supplier confirmation and Prairie Blue's final order review.

If we identify a material error or unavailable component, we may contact you to correct the order, offer an appropriate alternative, change the fulfilment timing or cancel and refund the affected item.

Orders, acceptance and payment

Submitting an order is an offer to purchase the selected products. An automated email or checkout confirmation means that we received the order; it does not by itself mean that Prairie Blue has accepted or released the order for fulfilment.

Before fulfilment, Prairie Blue may review component compatibility, availability, pricing, payment status and delivery information. We may contact you when clarification or a correction is required. The order is accepted when Prairie Blue confirms acceptance or begins fulfilment, whichever occurs first.

Pricing

Prices are shown in Canadian dollars unless stated otherwise. Applicable sales taxes are added at checkout. Any mandatory charge will be disclosed before the order is submitted.

Payment

You authorize the payment provider to charge the amount shown at checkout. Orders may be held or cancelled if payment cannot be verified or completed.

Prairie Blue may refuse or cancel an order for reasons including an obvious pricing or description error, suspected fraud, payment failure, product unavailability, an unsupported delivery location or a configuration that cannot be supplied safely or accurately. If payment has been captured for a cancelled order, the applicable amount will be refunded.

Shipping, delivery and inspection

Our Shipping and Delivery Policy forms part of these terms. Freight is included with complete pool-kit purchases shipped within Canada, subject to the delivery conditions stated on that page and at checkout.

  • You must provide complete and accurate delivery information and disclose access restrictions before fulfilment.
  • The freight carrier is expected to unload the shipment at the delivery location. You are responsible for providing a suitable, safe and accessible receiving area.
  • Delivery dates are estimates unless Prairie Blue expressly agrees otherwise in writing.
  • You or an authorized representative should inspect the shipment promptly and note visible shortage or damage on the carrier's delivery record before signing where possible.
  • Photographs, packaging and delivery documents should be retained when reporting a shortage, defect or freight-damage claim.

Risk of loss and legal title transfer as required by applicable law and the agreed delivery terms. Nothing in these terms removes rights or remedies that cannot legally be excluded.

DIY pool-kit responsibilities

A DIY Pool Kit is a product package, not an installed pool. Unless a separate written agreement expressly says otherwise, the purchaser is responsible for the complete installation project, including:

  • Confirming that the property is suitable for the selected pool and equipment.
  • Obtaining permits, approvals, utility locates and required inspections.
  • Confirming property lines, easements, setbacks, overhead restrictions and underground services.
  • Excavation, access, drainage, groundwater management, soil conditions and disposal.
  • Assembly, plumbing, liner installation, backfill, electrical, gas, fencing, decking, grading and landscaping.
  • Hiring qualified and licensed trades where required.
  • Following current manufacturer instructions, building codes, safety requirements and authority requirements.
Compatibility is not site approval

Prairie Blue's order review checks the selected kit components. It does not confirm property suitability, soil conditions, code compliance, permit approval or the quality of installation work.

Owner-Build and full-service projects

Information about Owner-Build and full-service construction on the website is introductory. Scope, pricing, schedule, exclusions, payment stages, change orders, warranties and project responsibilities are established in a separate written proposal or agreement.

An inquiry, consultation request or website form does not create a construction contract or guarantee project availability. Prairie Blue may assess project location, access, timing, site conditions and capacity before offering services.

Order changes, cancellations and returns

Contact Prairie Blue promptly if you need to change or cancel an order. Whether a change, cancellation, return or refund is available depends on the order's status, the type of product, supplier commitments, freight arrangements, product condition, applicable product-specific terms and applicable law.

  • Do not return any product without written return authorization and instructions from Prairie Blue.
  • Installed, used, damaged, incomplete or altered products may not be eligible for return except where required by law.
  • Custom, configured or special-order products may have restricted cancellation or return eligibility when clearly disclosed before purchase and permitted by law.
  • Approved refunds are returned using an appropriate payment method after the applicable inspection and processing steps.

Additional details will be stated in Prairie Blue's Returns, Changes and Cancellations Policy and any product-specific terms. Nothing in this section limits cancellation, refund or other consumer rights that apply by law.

Product warranties

Many pool, liner and equipment components are covered by warranties issued by their manufacturers. Warranty scope, duration, registration requirements, exclusions and claim procedures vary by product and are governed by the applicable manufacturer terms.

Prairie Blue may help coordinate a valid manufacturer claim but does not control the manufacturer's decision. Unless Prairie Blue expressly provides a separate written warranty, Prairie Blue does not add to or replace a manufacturer's warranty.

Warranty coverage may be affected by improper storage, handling, installation, water chemistry, winterization, unauthorized modification, misuse, neglected maintenance or failure to follow manufacturer instructions. Nothing in these terms excludes a warranty, condition or remedy that cannot legally be excluded.

Responsibility and limitation of liability

You are responsible for decisions, work and costs outside Prairie Blue's expressly agreed scope. This includes site conditions, third-party contractors, permit decisions, code compliance and DIY installation work.

To the maximum extent permitted by law, Prairie Blue Pools is not responsible for indirect, incidental, special or consequential loss arising from website use, delivery delay, product misuse, improper storage or installation, site conditions, third-party work or failure to follow current instructions.

Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. These terms do not limit liability for fraud, wilful misconduct, gross negligence or any other liability that cannot legally be limited.

Acceptable website use

You may use the website only for lawful purposes. You must not interfere with site operation or security, attempt unauthorized access, introduce malicious code, scrape or copy the website through automated means, submit false information, impersonate another person or use the website to violate another person's rights.

Prairie Blue may restrict access when reasonably necessary to protect the website, customers or business operations.

Intellectual property and submissions

The Prairie Blue Pools name, branding, website design, original text, graphics, diagrams and other original site content are owned by or licensed to Prairie Blue and are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial purchasing and project-planning purposes but may not reproduce or commercially exploit its content without permission.

You retain ownership of project photographs, drawings and other materials you submit. You grant Prairie Blue permission to use them as reasonably necessary to respond to your inquiry, assess the project, provide requested services and maintain related records. Prairie Blue will request separate permission before using identifiable customer project material for public marketing where consent is required.

Third-party services and links

The website may connect to Squarespace, payment providers, social platforms, financing providers, maps and other third-party services. Those services operate under their own terms and privacy practices. Prairie Blue is not responsible for third-party websites or services that it does not control.

Events beyond reasonable control

Prairie Blue is not responsible for delay or failure caused by events beyond its reasonable control, including supplier interruption, transportation disruption, severe weather, wildfire, flood, labour disruption, government action, utility failure, public emergency or material shortage. We will make reasonable efforts to communicate material impacts and resume performance when practical.

Governing law and general terms

These terms are governed by the laws of Manitoba and the applicable laws of Canada. Subject to any consumer right to bring a proceeding elsewhere, disputes will be addressed in the courts of Manitoba.

If part of these terms is found unenforceable, the remaining parts continue to apply. A failure to enforce a term is not a waiver. Headings are included for convenience. These terms, together with the policies and product-specific terms incorporated by reference, form the agreement governing website use and online purchases.

Prairie Blue may update these terms as the website, products or legal requirements change. The effective date identifies the current version. Terms applicable to an accepted order will not be changed retroactively except where required by law or agreed with you.
